Success Story: Immigration Judge Affirmed Cancellation of Removal to Our Client

On January 13, 2011, an immigration judge affirmed the cancellation of removal he granted to a Lin & Valdez client with the government counsel agreed to waive appeal.  The decision of the court will become final once our client passes the security check.

 

This matter represents another success of Lin & Valdez in immigration court.  Our client in this case was previously granted cancellation of removal after a lengthy trial by the same judge.  Nevertheless, close to the expiration of the appeal period, the ICE counsel filed appeal to the BIA.  Eventually this matter was remanded to the immigration.  After the matter was remanded to the court, we contacted and talked to the ICE counsel.  Eventually, we were successful in convincing the ICE not to seek retrial and waive appeal.  The ordeal of our client for not having legal status for about 20 years, to this point, was finally over.
