Sample Success Story: Cancellation of Removal Granted to Lin & Valdez Client

On March 20, 2013, after trial an immigration judge granted cancellation of removal to a Lin & Valdez client.

Attorney Stewart Lin again is the lead counsel in this matter and he argued for the client in the merit hearing of the removal proceeding. This case represents a huge challenge to our office as our client in this case was severely injured in a car accident many years ago.  Over the years, his cognitive ability, perception to surrounding, and language capability has deteriorated according to an evaluation by his doctor.  His is also disabled physically.

While the US government tried to remove this person, the client’s loving family, however, was trying to keep the unity of the family.  For the trial, Attorney Stewart Lin called four witnesses, including the respondent himself and his 84-year old father, to testify, and the testimony of the fifth witness was proffered and accepted by the government and the presiding judge.  After the trial, the presiding judge granted cancellation of removal, the government waived appeal, and we again succeeded in helping to keep a family whole.
