Following receiving the approval last week to a difficult appeal to an E-2 case, this week we received another approval to an E-2 treaty investor’s application issued by the USCIS. The approval is issued by the California Service Center to our client who invested in a construction material company.
The challenge in this case is that our client’s business model involves the hiring of a substantial number of contract workers compared with the limited number of employees he hires. Despite of that, we helped our client craft out a detail business plan explaining to the USCIS about the investment, the marginality of the investment, the creation of employment opportunity, and the positive impact of the investment in the local economy. The investment amount of our client in this case is just slightly over $60,000.00. Nevertheless, as we explained to the USCIS, under the current economic situation such a cash investment should be deemed substantial and should be granted. The petition was approved without encountering further questioning from the USCIS and was approved.
Over the years, Lin & Valdez has applied for countless numbers of E-2 cases. The investments our clients made for the applications are in a wide range of businesses, including beauty salon, restaurant, camera shop, doughnut shop, supermarket, gas station, convenience store, trading company, day care, bridal service, professional service, hotel/motel, computer company, franchise store, art gallery, and granite and stone business, etc. We have established ourselves a premier E-2 investment visa practitioner. If you are from one of the E-2 countries and are interested in coming to the US with this flexible visa status, or changing your status to E-2 in the US, please contact us immediately.
