Success Story: US Consulate Granted E-2 Investor Visa to Our Pakistani Client

Right at the beginning of 2012, on January 4, the US consulate in Islamabad, Pakistan notified a Lin & Valdez LLP’s client granting the E-2 visa to our client. 


Our client in this case is a Pakistani citizen.  For the purpose of investing in the US, he transferred fund of over $100,000.00 to the US to become a 90% shareholder in a company.  His company then purchased a gas station/convenience store in Texas.  Nevertheless, the most unique aspect of this case is that the completion of the purchase and the closing of the transaction is set to be contingent upon the US consulate’s approval to the E-2 visa of our client.  In the interim, $111,000.00, the balance of the purchase price, is entrusted to an escrow in the US to be released to Seller contingent upon the E-2 approval.


Another uniqueness of this case is that our client has yet to be in the US.  However, his 10% partner/shareholder has been helping him on the US side for the preparation of the application.


In 2011, Lin & Valdez LLP was firstly retained to prepare the formation of the client’s company and the purchasing of the gas station.  We prepared all the transaction documents, and the package for the E-2 application.  For the E-2 application, we provided the US embassy over 40 items of supporting document of different nature. Our client in this case also submitted extensive documentation to prove the legal source of his fund. The file of our client is about 2 inches thick.  Finally, our client received the notice from the US embassy about the approval to the E-2 visa application.  With the approval, he will soon come to the US to run his gas station/convenience store.
