A 10/14/08 USCIS update announces a final rule increasing the period of stay for TNs. It changes the initial period of admission for TN workers from one to three years.
Eligible TN nonimmigrants now may also be allowed to receive extensions of stay in increments of up to three years instead of the prior maximum period of stay of one year.
TN is a visa category available to eligible Mexican and Canadian with at least a bachelor¡¦s degree or appropriate professional credentials who work in certain qualified fields pursuant to NAFTA. There is no annual limit on the number of TN admissions to the US. There is no limit on the number of times a person can apply for a TN visa or seek admission in TN status. This final rule will extend the admission period for TN to a maximum of three years to be consistent with other nonimmigrant worker categories like H-1B.
