The USCIS announced today that it has received enough H-1B petitions to meet the H-1 cap for fiscal year 2006. This certainly is a big surprise to people who has followed the situation because less than 10 days ago, the USCIS just released an "update count" showing that about 6,000 quota is still available as of August 3, 2005.
As a result of the reach of the cap, the USCIS has determined that the "final receipt date" is August 10, 2005. Any petition received on that date will be subject to the random selection process. USCIS will reject any petition that are subject to the FY 2006 annual cap and received after the "final receipt date."
