Success Story: Saga PERM Labor Certification Certified for Catering Manager

After six years, a labor certification case was finally certified on February 23, 2007.  A legendary case in our office, which is an unfortunate saga of our client!

 

This labor certification was initiated back in 2001 when the Sec. 245(1) sunset.  At that time, our client went to see an inexperienced attorney, who filed a petition full of problem with combined job title and job duties.  The file came to our office when the previous attorney closed down his office after being confronted by many of his clients. 

 

To save this case, we helped the client revise the ETA 750 Form and submitted the revision to the Texas Work Force Commission.  Later, our client asked us to help them transfer it from the regular application to RIR, hoping to speed up the processing.  With the creation of the backlog center, the case was then transferred to the Backlog Center.  At the beginning of the PERM era, our client decided to switch to PERM.  The PERM application was filed in mid-August 2005, when glitches and problems were still abound in the PERM system.  For the application, we requested to preserve the May 1, 2001 priority date, and withdrew the RIR. 

 

In just a few days after the filing, audit notice was received on August 30, 2005.  On September 27, 2005, the response to audit notice was submitted with detail explanation and documentation about the complex history of this case.  The rest is history now.  This case was finally certified on February 23, 2007.  An amazing journey for our client!  How many six years we have in our life?  We are extremely glad that we help save this case.  The file of the case is very thick, because it contains a lot of tear of our client, and sweat of our staff!
