Update on Labor Certification Backlog Elimination Centers (BEC)

The Department of Labor ETA Liaison Committee of AILA today released an update on the current processing of the DOL Backlog Elimination Centers on the labor certification cases.  According to the update, as of early January 2006, the remaining regional offices of the DOL have been closed and the cases transferred to the two Backlog Centers. The Centers are reviewing the status of these cases and the national office is awaiting a final count. The estimate is approximately 2000. Where actions have already been taken in the regional offices, the cases will remain on the old Paradox system and will not be entered into the new system at the Backlog Centers. As DOL has previously stated, all other cases at the centers have had at least partial data entry. DOL expects to complete any required data entry on the new cases from the regional offices within a few weeks.

Also, DOL has been working on improving efficiencies and more closely aligning processing and procedures at the two centers. They have been looking at best practices.  However, the target for full data entry and to have 45-day letters sent out on all cases is still June 2006.  They do hope to finish even earlier.

The DOL have also established a new category of cases--those they are unable to locate. These may be cases that were cancelled/terminated at the state level and never left the state office. The category was created due to requests for screen shots for H-1B extensions beyond 6 years and the inability to locate the files.
