Success Story: BIA Granted Appeal and Remanded a Lin & Valdez Client Case

One December 31, 2013, the Board of Immigration Appeal (BIA) made its decision and remanded an asylum case we appealed for our client.

In 2011, our client’s asylum application was denied by an immigration judge.  Upon completion of the trial, the immigration judge concluded that our client was credible, yet for other reason the judge denied the application.  We strongly disagreed with the judge’s decision and appealed to the BIA.

In its decision, the BIA sided with our position, and pointed many defects and problems in the Judge’s decision.  As we argued and the BIA agreed, the Judge’s finding is flawed. Therefore, our appeal is sustained and the case was remanded.
